    Council

    Powers and Functions of the Tamilnadu Council

    The Council is responsible for ensuring the planned and coordinated development of education, determining and maintaining education standards, and performing its functions. To achieve this, the Council may:

    Conduct Research and Surveys: Undertake studies and surveys on various education aspects and publish the findings.

    Provide Expert Recommendations: Offer guidance to the Central and State Governments, Universities, University Grants Commission, and recognized institutions on education plans and programs.

    Coordinate and Monitor Education: Oversee education development in the country.

    Establish Education Norms: Set norms for courses, trainings, and institutions, including eligibility criteria, admission procedures, and curriculum standards.

    Develop Institutional Guidelines: Create guidelines for recognized institutions on starting new courses, providing facilities, staffing, and staff qualifications.

    Set Examination Standards: Establish standards for examinations, admission criteria, and course schemes.

    Regulate Fees: Develop guidelines on tuition fees and other charges for recognized institutions.

    Foster Innovation and Research: Promote and conduct research in education, disseminating the findings.

    Monitor Implementation: Periodically review and advise recognized institutions on implementing norms, guidelines, and standards.

    Enforce Accountability: Develop performance appraisal systems and mechanisms to ensure accountability in recognized institutions.

    Formulate Education Schemes: Create schemes for various education courses, identify recognized institutions, and establish new institutions for development programs.

    Prevent Commercialization: Take necessary steps to prevent the commercialization of education.

    Inspection

    The Council may conduct inspections of recognized institutions to ensure compliance with this Act. Here’s the inspection process:

    Inspection Authorization: The Council will authorize a designated person to conduct the inspection.

    Prior Notification: The Council will inform the institution of the inspection date, and the institution can participate in the inspection as prescribed.

    Inspection Findings: The Council will share its findings with the institution and, after considering the institution’s opinion, recommend actions to address any issues.

    Implementation Reporting: The institution’s executive authority will report back to the Council on the actions taken to implement the recommendations.

    This process ensures that recognized institutions are held accountable for maintaining standards and complying with regulations.

    Affiliation Process After Council Recognition

    Notwithstanding anything contained in any other law for the time being in force, no examining body shall, on or after the appointed day,–

    Grant Affiliation: Provide affiliation, whether provisional or permanent, to any institution.

    (or)

    Conduct Examinations: Hold examination, whether provisional or otherwise, for a course or training conducted by a recognized institutions.

    This provision supersedes any conflicting laws or regulations.

    Contravention of Provisions of the act and consequences thereof

     Withdrawal of Recognition: Where the Regional Committee is, on its own motion or on any representation received from any person, satisfied that a recognized institution has contravened any of the provisions of this Act, or the rules, regulations, orders made or issued thereunder, or any condition subject to which recognition under sub-section (3) of section 14 or permission under sub-section (3) of section 15 was granted, it may withdraw recognition of such recognized institution, for reasons to be recorded in writing:

    Provided that no such order against the recognized institution shall be passed unless a reasonable opportunity of making representation against the proposed order has been given to such recognised institution:

    Provided further that the order withdrawing or refusing recognition passed by the Committee shall come into force only with effect from the end of the academic session next following the date of communication of such order.

    (a) Cancellation and Discontinuation: The cancellation shall be communicated to the recognised institution concerned, once the recognition of a recognised institution is withdrawn under sub-section (1), such institution shall discontinue the course or training, and the concerned authority or the examining body shall cancel affiliation of the institution in accordance with the order passed under sub-section (1), with effect from the end of the academic session next following the date of communication of the said order.
